Justice James Omotosho of the Federal High Court, Abuja has said that the leader of the proscribed IPOB should either open a defense in the terrorism case against him or lose his right to defend himself.
This was the ruling of the court after Kanu failed, for the fourth day, to enter his defence after the prosecution closed its case and the court overruled his no-case submission.
Under Nigeria’s criminal procedure, a defendant can only enter a defence or waive his defence after the prosecution has closed its case and the defendant’s no case submission has been dismissed.
